can I sue an Insurance Company

On June 4th my husband called Peoples Trust and got a homeowners policy, not to start until June 12th. Within the hour, the same day, he called back to cancel and got the agents recording where he left a message to cancel. On his email was a letter from the agent, he replied to her to cancel this policy. He got an email cancellation form, we signed, but apparently I didn't get it to go through. I talked to a (not very) gentlemen the next day and told him NOT to put through the check. I said under Florida Law we have the right to cancel within 3 days and we cancelled within the hour. He claimed it went through on the 4th. The long and the short of this, they put through our check for $719.00 posted on the 9th. We are getting no response and need our money. We are about to turn 70. I have an anxiety problem and this has sky rocketed me way beyond the control of any pill. I'd like to sue, they broke the law, they should be punished.

Unless you have a specific legal cite to the contrary, I am unaware of any 3 day right to cancel related to homeowners insurance. While you may get a refund for "unearned premiums" you may well have to wait until the insurer processes the check and then issues a refund.
