More details to this question:
I bought my phone in September, since week 1 I called them to let them know my phone was acting up battery draining , call dropping, they sent me to the apple store. Apple said the phone is working so you must talk to sprint. I have been calling sprint every single month since i got this phone and nothing its just troubleshooting my phone make it work for a week then goes back to the way it is. i had a manager via online info that she was going to give me another phone if the issue was not resolved once i took it to a sprint store once again, I took it to the store, my phone worked for about a week. I gave them a call yesterday demanding a new phone as it was promised, the assistant manager said we cant do that, the problem is the phone not the network. the manager said i cant help with that i will have the escalation team give you a call.called me a liar, said the problem was the network, when i told him impossible because i have trlaved out side miami, he hung up. and much more

Yes. It sounds like a breach of contract suit of some sort, though it may cost you more to file suit than to simply cancel the contract and go to another provider.
