More details to this question:
I sent my desktop to Dell technology for repairs , I was very specific not to touch my data and didn’t accept the quote they sent me till I got a confirmation from them support agent that my data won’t be touched and they will not reinstate the operating system but during the repair process they didn’t anyway without taking my consent which caus d my data loss completely that includes my business documents and data, my personal document and very precious family pictures, I have proof of this in my email, do I have a case against them can I sue them for negligence?

Not likely. Its simply common sense any more that if you have ANYONE perform repairs of any type on your computer that YOU are responsible for making and keeping a data back up, precisely for the this reason. Adding to this 99% of such services have waivers and exclusions related to data loss and reinforce the obligation of the customer to maintain a proper back up
