QUESTION

Deposit with no contract

Asked on Jan 18th, 2024 on Consumer Law - Florida
More details to this question:
A client was sent a contract for a wedding photography services. The client sent a deposit without signing the contract. The client later then ghosted the photographer and cancelled on them. They are asking for the deposit back but they never signed the contract. Do I have to refund the money? I have a paper trail attempting numerous times to get in contact and they responded days later saying they’re canceling and not going forward with service.

Unless you have a signed contract, its not worth the expense and controversy squabbling over a deposit where you did nothing as far as work. This is on YOU to make sure that customers sign the contracts if you expect to enforce them.
