QUESTION

Filing a lawsuit against a rogue handyman

Asked on Jul 06th, 2016 on Consumer Law - Tennessee
More details to this question:
Hi. I have a handyman that I paid 50% for a $4,300 job on 6/16. On his work order, there is no mention of dates. However, I have a text before the work order was signed that he would have the job 100% finished before 6/28 and maintained that statement verbally all the way up to 6/23 when barely any work had been done. He has only shown up to work once and, as of 6/25 when he still had not shown up and his phone wasn't working, I sent and email telling him not to come back (and that I have to fix the work he had done), to which he has briefly responded. I've said I will pay him for the materials (with receipts) and 4 hours of work, which is all he put in. But want a refund back by today, 7/6 of the rest. No response. I have said that I will be taking him to court and will also sue for any fees associated with a case. I have all my phone and email records. Can you help me? What do I do next? I would need to subpoena records from a check cashing place to obtain his info
