Implied warranty for major appliance purchase

Purchased Kitchenaid electric range. At time of purchase was told it had 5 year warranty. Malfunctioned and burned out in less than 2 years. Now told that 5 years applied only to certain parts of appliance, not affected parts. Can manufacturers and retailers engage in such deception? How can manufacturers and retailers limit major appliance warranties to only 1 year? How is this consistent with implied warranties and expectations of consumers based on marketing representations of manufacturers and retailers, e.g. Maytag lonely repairman ads, etc. Do I have rights under federal law? Can I sue in state court for damages? Can I recover attorneys fees? who do I sue? Manufacturer or retailer? Why is this not a proper subject for a class action? It is very simply consumer fraud, deceiving the consumer about the reliability of a major appliance which should last for years without problems.

Vitually ALL warranties are in writing and provided with the manual or materials when the appliance is purchased. Typically, there is no claim here because the warranty information provided in writing is either not read or misunderstood by the consumer. Advertisements are of no issue unless they are clearly misleading, and the Maytag repairman ads, would typically not be so unless they stated there was a 5 year unlimited warranty on anything that goes wrong on all models, etc. If you have further questions, feel free to contact us at 1-800-922-6442 for a FREE consultation.
