Late fees accessed by wamart

More details to this question:
My Payments are due on the 5th of every month, I make my my payments every month early morning. Before the cut off time, by mid afternoon a late fee is showing on my account. I called customer service and there explanation is we do this in case the payment is return and when it post to account we drop the late fee, is this legal to do. It never was done before.

If you make payments at the last second - you run the risk of all kinds of unnecessary issues to deal with. It is equally unlikely that your payment due date is the 5th as opposed a grace period for late fees applying until the 5th. You better bet is to pay BEFORE the due date not wait until the last second or try to work an issue of mere hours regarding payment.
