QUESTION

Under what category does this fall

Asked on Mar 26th, 2013 on Consumer Law - Florida
More details to this question:
I am looking to pursue an injunction against Daytona Toyota. They sold me a car and refuse to provide the master keys which falls under things included with a certified pre-owned toyota. I have made several attempts to rectify this problem with both the corporate office and the dealership itself. According to the dealership the key was mailed, but they have no proof that it was sent. They also refuse to cover all costs that would occur with having the key made at a local dealer that is not Daytona Toyota. After purchasing the car I had to move to Toledo, Ohio for work. Daytona Toyota Insists that I come to their shop and they will fix the problem. Only thing is that Daytona Beach, Fl is over 1000 miles from Toledo Ohio.

Much of the dipsute you describe is contract based issues. If the master key was mailed and lost, they obviously cannot provide that particular key, bu tmay be liable for a replacement depending on your contract terms. If the car is used, the certification may be at the dealer level and they may be within thier rights to require work to be done in thier location if you want it done "under warranty" so to speak. Again this will revolve around your contract terms.
