More details to this question:
I took out parent loan for my daughter to go to college and then loan was dismissed. Who is entitled to keep the refund from overpayment?!

I do not entirely understand the question, but the person on the loan application is presumptively entitled to proceeds; if there is an equitable claim to be made, then the person who incurred the dtriment/loss usually prevails.
