I paid for a truck in cash. We have a contract that he's to pay me back and it also states that I can charge him if he stops making payments. I've not charged him anything additional but want to start getting paid. The last paymnt was made in June 09. He stated July 1, 2011 that he was going to start making payments again and nothing was sent. Then in March 2012 he stated that he was getting pinned & stated again that he'd make payments. No payments have been made & he owes me $35,811.90. How do I go about getting the money deducted from his pay to ensure that I'll get everything that he owes me?
You need to file a complaint in court for breach of the contract between the two of you. You will have to serve it on him in a specific manner because he is in the military. If he does not answer the complaint, you will get a default judgment, and then you will have to register that judgement, its called "docketing". Once you get a docketed judgment, you can send that to the area where he is stationed, and ask for a wage execution. If you know where he is working you can ask for the wage execution directly in satisfaction of the judgment. Good luck.
