Apartment is not ready 3 weeks after agreement

Moving from Buffalo NY to Nashville TN May 28, we see a model apartment in person in TN. Go back to NY June 18, via online an apartment in the complex is selected 2bd 2bath, which states ready June 20, but can't be seen or occupied until July 9 due to jobs. On July 9, move in day, asst. manager of complex hands over keys, but doesn't walk unit with us. 18 items sited and reported including Mold, Burned outlets, 2 toilets don't work. Maintenance asked to fix toilets, but walks out before fixing either. We are told the manager will return on Monday, July 11. We don't move in (stay in hotels 3 nights), return on Monday. Manager walks apartment and acknowledges all issues, but claims "these are all things we can fix". Question - they had 3 weeks before we arrived and 3 days after we arrived and toilets not working. They are stating that we are breaking the lease, owe penalties and term fees. What is our course of action. We have a lot of pictures of everything.

I am assuming based on your question that you have informed them that you do not want to move into the apartment or have found another place to live. If this is the case, them move on and don't worry. Even it they sue you (which I doubt), then you will win.
