I have a 3 year contract with a company to exclusively advertise on my website. We agreed on a certain commission per sale for anyone that buys an item on their website that clicks through a link from my website. I am an affiliate (a sales person working on commission). At the beginning of the third month into the contract, the company contacted me and said the agreement is not working for them. They wanted me to agree to a new much lower commission rate. I didn't agree to the new terms. They said that if I didn't agree to the new terms, they would simply send all my traffic to their lowest converting products and pay me nothing. They created a landing page for traffic coming from my site that shows higher prices for the same products. Revenue has dropped 50% compared to the first two months. There are hundreds of other affiliates that work with this company as well. I bring this up because when I click through the links on other affiliate websites, I see the regular (lower) prices.
Sounds like you probably have a breach of contract claim against this company. I would have to review the actual written agreement to know for sure where you stand, but as you describe the facts they certainly sound like they are in breach.
Let me know if you would like my assistance reviewing the agreement.
Thanks,Jon
