Book out of contract issue

More details to this question:
I have a book that was under contract and after the contract Ended, amazon (dot) com is still trying to sell it. So in the beginning Of the year I wrote emails to both amazon and the publisher in regards To the issue and neither of them replied. However, amazon seems to still Try to sell the out of print book, and does not have any copies. I know, cause  A fan tried purchasing thru amazon and after a month of them writing her emails On how they have yet to send out the copy, she cancelled the order. So, I wanted  To pursue legal action as soon as possible and file suits to both the publisher and Amazon.
