While under mandatory stay at home orders I allowed my son and his girlfriend to stay with me. I had a notice taped to my door that I had 7 days to get rid of them, so I did. Unfortunately they came back a month later and I told them they couldn't stay as to what my landlord had ordered. I ended up having to call the police to make them leave. All of this took place yesterday afternoon. My landlord called me and informed me that he was evicting me and I had seven days to get out. I informed him that I had just paid the rent that morning he said he'd return it today but as of yet nothing. Some of my neighbors had told me that if you call the police he'll evict you. I live on a fixed income and can't come up with the amount it will take to leave like he ordered. He has judged my son by old Facebook pictures that he had posted. What are my options? He hasn't complied to everything they have in their lease. Their leasing agent let my son into my apartment while I was gone.
The governors stay does NOT apply to non-rent based lease issues. The landlord can and will likely be successful in evictinhg you. If you were given a 7 day notice to get your sone and his GF off of the property because they were not tenants nor allowed to reside there, and then you allowed them back in when "the coast was clear" and the LL caught it - you walked right into a lease violation and eviction. Unless you can smooth things over with the LL, you are going to be in a bind and it won't matter that you can't afford to move, the Sheriff will physically toss you tpo the street when the LL gets a writof possession. To be clear - you are equallyt NOT entitled to your rent back so the landlord isbeing pretty nice to give you the rent money back, presumably if you leave on your own.
