QUESTION

Can he go to jail

Asked on Nov 22nd, 2014 on Contracts - Texas
More details to this question:
In February 2013, my son stole some stones from his father, his father claims they were worth $20,000. When my ex found out he made my son sign a contract or he would press charges. The contract required that my son pay $500 a month, which he has been doing but he has come into some money problems and he and his pregnant wife can not afford to pay this amount. They have tried to discuss lowering the payment but my ex says payment in full or my son can go to prison. Does my son have any options. If he only pays what he can afford, can he actually go to prison. This happened in Texas. My son now lives in Florida.

He can go to prison (theoretically) for stealing the stones in the first place, not for breaching the contract to pay damages.  I don't practice criminal law, much less in Texas, but if your son has an otherwise clean record and has been doing his best to repay the victim, I don't think he would go to jail.
