Can I get any deposit back when contractor died?

More details to this question:
I gave the roofer a deposit. Materials were delivered to my home. He unexpectedly died before any work was done. His spouse will not return phone calls or emails. Can I get any of my deposit back? Do I have a Small Claims court case?

If it was a corporation, small claims is fine. If it was an individual, you are going to have to bring a claim in the estate of the person, if it exists. Or, you can do small claim and sue the contractor and the wife as the recipient of the money.
