I was in a weekly contract with a buy here pay here car lot. I made my payments on time every week.I started payments in January of 2014. In March 2014 I sent two payment through the mail via money order. The car lot informs me later that they did not receive payments that put me behind. I asked to make my payments monthly temporary and the car lot agreed and charged me late fees. I started making monthly payments off a debit card over the phone. The car lot made me pay more to make up for the missing payments. I paid on time every month exactly what she told me to pay. October 2014 I informed the car lot I was going back to weekly that was the contract. I paid two and a half weeks in advance and the owner agreed on that accepted the payment and two days later the car was repo. I call the car lot and they laughed saying there is nothing I can do and refuses to give me the information to the place that repo my car. My wallet kids socials money and personal belongings are aslo in the car
You're entitled to get your personal items from the car. You should be able to call your local police department to see if the repo agent notified them of the repo as they are supposed to do. Obviously, you have had some payment issues with the car lot that suggest your statement of paid on time all the time may not be quite accurate and this can be a problem claiming a wrongful repo. YOuwill simply need to retain an attorney to review this with you. If you have any questions or concerns, please call our office at 1-800-922-6442 for a FREE consultation.
