QUESTION

can I get out of contract that was never commenced?

Asked on Apr 02nd, 2017 on Breach of Contract - North Carolina
More details to this question:
our company signed a contract for 6 months of SEO service. Although contract was signed, the services/work was to commence at a later time. Due to our delay and change of circumstance and some red flags we discovered, we want OUT of the contract. We admit, the delay in beginning work on the contract was our fault. We are willing to offer a one-time payment for the inconvenience we caused. Is this something we can get out of?

Not unilaterally.  With minor exceptions that don't appear present here, once you enter into a contract, you are bound by it (barring fraud, illegality, duress, or other reasons why the oontract would be invalid or unenforceable) regardless of when performance is supposed to commence.
