More details to this question:
i posted a 3ds on eBay. it was bought for 200. i do not want to send it off. can i be off the hook for keeping the item but sending this person their money back?

Technically the buyer could sue you for breach of contract, but I doubt he/she will, or, if he/she did, would be able to show any damages, if you refunded the money. I don't know what a 3ds is, but if it is unique, and the buyer really wants them, he/she might be able to get a Court to compel you to fulfill the contract.
