QUESTION

Can I sue my videographer

Asked on Aug 26th, 2018 on Contracts - New York
More details to this question:
I got married July 29, 2017 and signed contracts in November 2016, as per the contract all deliverables were supposed to be delivered within 90 days, which I know doesn't happen. Its been over a year since i have gotten married and have not received any raw footage nor my full wedding video. I have a track record of emails and text being told false promises and dates and now no response at all. I tried called my bank to put in a claim but was advised its been a long period of time that has been passed by. I have been a laughing stock in front of friends and families because they think I couldn't afford a videographer for the wedding since i don't have anything to show. I need a lawyer asap to help me build a case.

You can sue for the money in Civil Court but compelling production of the video would take a Supreme Court suit.

The answer to "can I sue?" is always yes, the question is whether you would win.  From what you've written, you appear to have a good claim to get your money back.  I don't know how much you paid, but it is very doubtful that it was enough to make it worthwhile to hire a lawyer; it's probably a small claims case.  You can only recover for breach of contract, not for appearing to be a laughing stock.
