As malpractice is defined, an attorney through their malpractice in a criminal case caused the defendant to be denied of his freedom, can action, of malpractice of an attorney be presented as an allegation thru a post conviction relief act, be presented to the courts for a judgment of relief of that denial.

If I understand your question, a conviction can be overturned on the basis of ineffective representation, but it is very difficult to prove.
