QUESTION

Can my contract be canceled/voided if there is an incorrect date?

Asked on Jul 13th, 2016 on Contracts - Georgia
More details to this question:
My question involves housing contracts. I signed a contract with an apartment for August through July of this year; however, there was an error in the contract and while the move in date is in August 2016 the contract I signed has the payment date starting August 2065 and ending July 2017. They sent an amendment, which I have not signed. Legally, can they cancel my contract if I do not sign? Can the original contract be voided if I do not sign? Basically what are the ramifications if I do not sign the amendment?

Since the mistake in the original contract appears to be an obvious typo, I don't think it would affect the validity of the contract which, barring any other problems, would be enforceable.  The other party cannot force you to sign an amendment.  However, that doesn't mean that the other party may not take the position that the original contract is invalid, and that, absent a signed amendment, there is no valid contract.  If so, you may have to go to court to resolve the dispute.
