Remedies of Borrower. Upon the occurrence of a Lender Default hereunder, the Instruments shall be immediately returned to the Borrower via, EUROCLEAR, DTCC or SWIFT MT 542 FREE OF PAYMENT. Neither failure nor delay on the part of the Borrower to exercise any right, power or privilege under this Agreement, any other Loan Document, applicable law or otherwise shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power or privilege preclude any other or further exercise thereof or the exercise of any other right, power or privilege.
