QUESTION

Contract breach - paid in advance (via loan) for work that was not done

Asked on Jun 12th, 2020 on Contracts - Florida
More details to this question:
I contracted with a company to do finishing work on walls and ceiling involving mud, tape and sanding. I was talked into taking out a loan of $3,500 to do this and other work (and feel I was deceived by cost). This was contracted on 3/6/2020 and, to date, the finishing work has not been done - I'm being told the company doesn't have a professional to do the work and they offered to refund $100. I talked to other contractors to finish the work, and was told it would cost $1,000. I want this company that was paid but didn't complete all work to reimburse at least this much so I can pay someone else to finish the work, as well as pay legal fees.

Unfortuately, this is the problem with paying for work in advance. Its not finaincially viable to hire a lawyer or sue over a $1,000.00 dispute. You can do it - but it will likely cost more than the amount in dispute. The notion of a lawyer taking such as case and trying to get paid from the oher party is unlikely and any lawyer foolish enough to do so is likely not bright enough for you to hire, as collecting money from handymen is near impossible.
