QUESTION

Contract Loophole

Asked on Jul 16th, 2015 on Breach of Contract - Florida
More details to this question:
My mothe in law called a pest control company. They did not tell her over the phone that it was a 5 year contract and that they would only be coming out 1 time a year. She pays them 120 every 3 months. When they came out to our house to do the service she had to be at work and told me they were coming when they got here they told me that they had talk to her about everything and had me sign the paper work. Now that she is trying to get away from them they will not let her leave. She does not want there service anymore because there was 1 time we tried to get them to come out I could not get them to come and now they are saying there service is for only 1 time a year but we still pay them every 3 months for a year now. Please I need some help.

Well, unfortunately this is not an uncommon situation.  It is possible that the contract is enforceable, but it is just as possible that there's room to get out of it.  Also, I can't tell from the description what they had you sign, but I'd be hard pressed to find a way for them to hold your signature against your mother-in-law.  Generally, I'd point you to the termination clause of the contract, but here it looks like there are a few auxillary issues present.  I would highly suggest that your mother-in-law have the contract reviewed by an attorney... and potentially hire an attorney to negotiate a way out.
