Contract not honored between myself and Morgan Buildings and Spas

On Jan 5,2013, my wife and I went shopping for a portable building and solicited Morgan Buildings and Spas, of Midland Tx to build one and also for a spa kit my wife ordered. We gave A down payment of $6,000 and signed a contract stating a 2 month build and deliver time frame. As of May 14, 2013 There is no building built, my calls to the salesman are that he will check on it and call back but never does.Calls to the Corporate office go directly to voice mail on all departments including the operater. I have stated to the salesman that we just want our money back but instead insists on checking with the same corporate office that won't even answer their phone

It sounds like you have a good claim under the Texas deceptive trade practices act.  The issue in these cases is usually collectibility - can the defendant pay if you get a judgment against them?  I would hire a lawyer as soon as possible before his business goes under.  Usually in cases like these you aren't the only one they've done this to and you don't want to be the one left without a chair when the music stops.
