QUESTION

Do I have a case?

Asked on Jul 19th, 2024 on Contracts - Florida
More details to this question:
In 2010, I purchased a Dodge Ram 1500 pick-up. In addition, I purchased for that vehicle, a lifetime warranty that covered anything mechanical plus parts and labor. My warranty material goes into great detail about the definition of the term lifetime. It does not refer to the life of the vehicle, but the life of the original purchaser, which is me. Recently, my motor experienced broken components internally. The local dealership tried to secure a new motor under the terms of my lifetime warranty but was denied by headquarters. Their reasoning was the cost of a new motor is more than the value of my vehicle. They unilaterally decided to buy me out of my warranty for $9000 whether I like it or not. I was left with an unusable truck with the motor removed and disassembled and they won't repair it. I had to sell my truck as junk for $800. I have not yet received the check for $9000 that is supposed to be on its way, is it worth my while to sue for damages and breach of contract?

There is no means to answer such a question absent actually hiring a lawyer to review the contract terms. I can honestly say I have never seen a "lifetime warranty" on a wearable/consumable mechanical product like an entire vehicle. That immediately suggest something is shady about such a warranty from the onset. You need to retain a lawyer BEFORE you do anything further.
