Do I have a lawsuit against this company

I was referred to a company that was going to help me in obtaining a $1 to $1.4 million loan to acquire a business. This company charged me upfront fees totaling nearly $40,000.00. I signed a contract with them which guaranteed the loan for the amount stated above by a certain date. I have not recieved a dime from them and they have not returned any of my calls or e-mails. Do I have a valid lawsuit against this company? What could I claim in damages? How do I determine of they are capable of paying a judgment prior to filing a lawsuit? How do I find an attorney that is willing to take my case?

Based on the facts you have mentioned it does sound like you have a valid lawsuit against this company.  Your damages would include your consequential damages.  This would include all costs associated with dealing with the breach.
