QUESTION

do I have the right to go ahead with purchase?

Asked on Jun 18th, 2014 on Breach of Contract - Florida
More details to this question:
I signed a contract for purchase a condo on May,15. Included was an authorization to do a background investigation on me. Closing was arranged for June 3. It was not ready, so closing was moved by realtor to June 16. On that date realtor tells me that investigation was not finished so closing is to be moved 3-4 days ahead. Next day, realtor tells me I was rejected by the homeowners association. I had already paid in full the condo purchase. Money deposited with closing attorney is to be returned to me. My questions are: Does the HOA has the right to impede my purchase? They have the right to stop me for living there, but how about the purchase? Do I have the right to be reimbursed for my money expenditures (hotel, airplane fare, food, since I had moved away to wait for closing date)?. Do I have the right to go ahead with the purchase, not live there and place the condo for resale? I am 66 year old, The condo is an over 55 community and I am hispanic.

Much of this depends on the reason for the rejection. While you intimate that it was because of being hispanic, I assume there is something bad about your background that was at issue? If you have further questions or would like to discuss retaining our services, please feel free to call 1-800-922-6442 to arrange for a FREE consultation.
