QUESTION

employee breach of contract

Asked on Sep 29th, 2019 on Contracts - Arizona
More details to this question:
I have an employee who signed a non compete contract in a 25 mile radius for a period of 3 years after leaving my fitness studio. They have left and will be opening a studio/salon in the next month within 5 miles of me. They also contacted all their clients of their plans. Can I get a court injunction to stop them from opening?

If the restrictive covenant is deemed enforceable by the court, you could obtain a preliminary injunction, but this clause is so broad for your industry for a regular employee that there is a good chance it will not be enforced.
