QUESTION

engagement ring

Asked on Oct 21st, 2013 on Contracts - New Jersey
More details to this question:
My fiance broke off our engagement, said via text she would send the ring back but never did, (this is the only proof I have that she broke up with me and said she would send it back in my cell phone is this enough?) I live in NJ and she lives in PA, it's been a month and she refuses to send it and has been ignoring me, I don't have the receipt anymore but I think I can get one from the jewelry store if I ask, if I take her to small claims court, if I don't have a receipt, will this be a problem? And is this even possible since she lives in PA? thank you

Putting aside which state law to apply, an engagement ring is the intent to enter into marriage. Because no marriage took place you are entitled to the ring. The only way she would be entitled to the ring is if it was given to her as a gift (Christmas, birthday, etc.) . A letter needs to be sent to her and if that does not work a complaint needs to be filed as soon as possible.
