Faulty installation of hurricane windows by a window contractor

More details to this question:
I had hurricane windows installed almost 10 years ago for almost $8,000. Recently I had to have three of these windows taken out to repair the frame and discovered the wood above and below would have to be replaced due to past termite damage and to secure the support of the windows.. The area was treated for termites in August 2007, and the new windows were installed in early September 2007. The window contractor ignored the wood above the windows that had been damaged, used excessive caulking to hide it, and excessive screws to support the window. My warranty is for 10 years for product and installation. This project is costing me over $3,000 and I believe the window contractor is liable for ignoring the problem when the windows were installed

You have a warranty lawsuit if they wont pay for the replacement BUT you may have to prove the damage didn't occur AFTER the installation.
