QUESTION

How binding is a separation agreement

Asked on May 31st, 2016 on Breach of Contract - Florida
More details to this question:
I was recently laid off. In order to receive any severance (including vacation time that should be due me regardless) I am required to sign a separation agreement which includes a statement that all monies will be paid back if THEY determine I have not held up the agreement. The entire contract written by them, protects them, but in no way protects me. They have covered all their bases. There is even an ambiguity clause covering everything. They got me over a barrel. I need to money to survive, but they could try and get it back at any time.

You can't have your cake and eat it too. If you want to preserve any right or claims you may have, you dont sign separation agree emtn and you don't take the money. If you sign, generally you are bound, and it will obviously be slanted in thier favor, thats what they are buying from you for the money they are paying you.
