I was indirectly served with a summary judgment motion by a party whom I am currently suing in small claims court on about January 5th, 2018 in response to my request for a Trial De Novo, served on November 12th, 2017. This service was proper as the address that these papers were sent is that of my bankruptcy attorney's law office, who is not a party to this action, nor is he representing me in this action. My legal address is included on all of the prior papers filed with this court, including the complaint a Demand for Trial De Novo. Defendant also indicated an incorrect return date of February 12th, a legal holiday on which the courts are all closed. The SJ motion is due to be reviewed on February 26th. 2018.
