May 2016 my home burnt in kitchen and lots of smoke damage in rest of house. I hired a contractor. Servpro. I paid $18,000 down. Rest due upon completion. They took out all old stuff from kitchen and front room they washed walls that were smoke damage. They put up drywall in 2 rooms and 3 windows. They say they done $18,000 of work and wanted rest of money before they finish the job. I refused to pay till job was completed. As that is stated in contract. They refused to refund my money now I have no home because its not livable. Can u help me on a contingacy. Base
Did you have insurance? Usually the contractor gets paid by the insurance on completion, but you have not mentioned insurance. The deal is governed by your contract. Have you offered to post the money in escrow so the job can be finished? This is not a case usually done on contingency. The cause of action is commercial and the damages too low.
This sounds like an unusual contract. Contractors generally get paid in advance, in increments, in order to buy the materials they need to do the job. You're saying your contract provides that the contractor lays out the money for the materials and gets paid after he does all the work. Are you sure about that??
No attorney will take this on contingency unless you have proof of the value of the case. That is calculated by the cost to finish the job, based on outside estimates, minus the contract price. If you find a contractor who will finish the job for less than the contract price, good for you- go for it. But you have no case, because you have no damages. If other contractors want more money to finish the job than your current contract price, the value of your case depends on how much more, calculated as per above.
