QUESTION

Is non-compete enforceable if only one of the parties involved signed it?

Asked on Aug 24th, 2017 on Contracts - Texas
More details to this question:
I signed a non-compete in 2014. My manager at the time told me to sign it right then or go home. It was done 5 months after a position change. In 2016 I changed positions again, this time no asked or brought up the new non-compete. So, I thought I was clear of this non-compete. I have since started making preparations to start my own company and received a cease notice in regards to my post employment obligations. Scope of the non-compete is One year and 50 fifty miles. I was the only party that signed the non-compete.

Non-compete covenants are more carefully scrutinized by courts than other types of agreements, and there may be reasons that your non-compete will not be enforced, but the fact that only you signed it is probably not one of them.  As a general rule, to be enforced a contract only has to be signed by the party against whom enforcement is sought.
