landscaping contract

More details to this question:
Late Aug. 2023 i have contracted E'S landscaping LLC. owned by Ethan Sitler to replace an attic fan, repair and replace a garden shed roof and exterior walls, build a three row garden bed, for a fee of around $3700.00 i payed half of the amount as downpayment, i did select shingles from what the contractor offered/texted, the job should have been done late September 2023, the raised garden bed was cancelled because the contractor couldn't find stones/flag stones similar to the ones that i already have, the contractor cut communication from Mid September 2023 to late Oct. 2023 rescheduling the shed project and attic fan to the first days of November 2023, another rescheduling, i asked the contractor to cancel the attic fan project because it became unsafe to work in that early cold two weeks of November (rain/roof frost), contractor didn't like it in his last text on Nov. 4 2023 and postponed the shed work to spring 2024,till now the contractor doesn't reply to any kind ofcommunications

Send a writing to the contractor: he either confirms the contract in writing or refunds your money. If he does not reply, sue him in the district court where his business is located.
