payment for legal service

More details to this question:
I filed a wrongful termination suit 2 years ago. I have been informed that it is now going to mediation. In the information package I received it states that the law firm will include a list of cost charged to me and the 40% contingency fee as agreed to in the contract I signed with the law firm. Here is the issue. I never signed the contract. What is my legal duty. I have never been billed for any work done. I never paid the filling fee that was required or gave a deposit as required in the contract. Here is the question. I never signed the contract. What are my legal obligations? The law firm combined my case with another individual from the same company with out either of us being told about it. He has since dropped out of the case. He was not billed for any service. The Firm required an up front payment for filling the case and a deposit against costs. This was not done. No billing of any cost have ever been sent to me

I would count it as a benefit to you that your lawyers were lax in making you pay costs. I would caution you about "puttin the screws" to the lawyers who are doing YOU a courtesy by taking the case on a contingent fee as that is what so often drives lawyers to refuse such cases absent pre-payment of a retainer. You should never cut your nose off to spite your face. If you have legitiamate questions about this, you should raise the issue NOW so you and the lawyer can work things out before anything else happens.
