QUESTION

Person failure to pay loan.

Asked on Jan 21st, 2019 on Breach of Contract - Texas
More details to this question:
I had a verbal agreement to help someone with a loan to finish a cabin. He had poor credit and I agreed to take a home depot loan that he would pay. From day one it was set up for the money to be auto drafted from his bank account. It was auto drafted from that account until the project was not going to work out so he closed this account. I have text messages confirming this is his account. I do not want to be stuck with his debt.

You are responsible to repay the lender but, assuming that the judge or jury believes your account that it was your friend's obligation to pay this loan (and it seems as if you have substantial evidence to support your claim), your friend would be obligated to repay you for any money you have to spend to satisfy the loan.  Of course, this assumes that your friend has the financial ability to pay you back.
