QUESTION

Photo release waiver for minor

Asked on Apr 28th, 2018 on Contracts - New Jersey
More details to this question:
My 16 year old daughter,(who is in the union) went to a birthday party at a laser tag place. They want a parent to sign a waiver releasing all use of her photos, her likeness and her name indefinitely. As she is a working actor, I certainly can’t do that. I printed out the electronic release. Crossed off that section. Initialed and dated it. They would not accept it because it wasn’t done electronically.... though electronically I am given no way to opt out of the photo release. Hence this forced me to sign the electronic waiver and give away all my rights. I am in Nj. Is this legal?

I believe the contract is enforceable  While there is a rule of law that a contract procured by duress is not enforceable, I don't think that rule applies here.  Although you claim you were "forced" to sign the contract, the laser tag had the right to ask you to sign the waiver before it allowed your daughter to enjoy its facilities, and you had  right and the ability to refuse, with the only consequence being that your daughter could not go to a birthday party.
