I have been sued for breach of contract, and i need to hire an attorney to help me . In oct2007 My wife which was my girl friend at the time,Refinance her condo apt and bought a quik stop gas station. But after paying all the franchisee fees she had to carry on port of good will so she sign and noterise 5yrs contract with old franchaisee, as i mention ,we was only friend ,and all the paper works and contract was on her name with both corprate and also note with old franchisee (which his name is Cyrus )and i was working there with her, as time pass on 2008 we got married , and she was paying Cyrus as she was supost, for 5yrs. On Dec2011 corprate decide to not renewing the master lease with landlord and terminate her franchisee agreement ,but they said because they are happy with her they will offer her to take over one of corprate store under new agreement with her for new store, and even the new contract was under her name(Sabrina). As we relocate in new store under new franchisee agreement, mr. Cyrus ask her to sign a new contract with him for new location, even that his name wasn't in her new franchaise agreement ,still she sign it and he said to void a fee for noterising the agreement which had to pay first time, he just made a copy of old one and just he change the adress and date , also he ask me to sign the contract as a witness, so i did, and she was paying him every month until april 2013 that store closed do to city of modesto (Pelandale project )and corprate got all the money that city paid, and corprate gaved Sabrina 1/3 of goodwill, Now Mr.Cyrus sued Sabrina&me for breach of contract and rowing my repetition and my credit too even that my name never been in any document.i need to know can he do that legaly ?and can you help me to defense my self?
This situation sounds a bit too complicated to provide you with a good response, but if you weren't a party to any of the agreements you most likely should not have been personally sued. Please feel free to give me a call if you would like to discuss this in more detail.
