QUESTION

Postnuptial Agreement

Asked on Jan 16th, 2016 on Contracts - New York
More details to this question:
I am 26 years old and I have been married for almost a year (no children). I am the only one working and taking care of all expenses and noticed that my wife isn't motivated in getting a stable job/career and also has a terrible habit of squandering money. I would like to purchase a house but I am hesitant knowing that I will also be the one responsible for all the added expenses. I also know that if we divorce my wife will be entitled to half of all my assests. Will a Post-nuptial Agreement protect me from this outcome?

First of all, the statement that your wife will be entitled to half your assets if you divorce is an overgeneralization.  It depends on a lot of factors. A properly executed postnuptial agreement which is entered into between fully informed parties without duress will protect you from the outcome you fear, assuming that your wife will agree to it.
