QUESTION

Security deposit for a condo lease

Asked on Jan 30th, 2014 on Breach of Contract - Florida
More details to this question:
Hello, A week ago or so I signed a lease for renting a condo in Florida. According to the lease I had to give a Security Deposit via Cashier's Check ¿¿ the realty, and so I did. Next day after signing the Lease I was let go from my job. Without the job I won't be able to pay the rental and even get the Condo Board approval, so I immediately called off the lease and asked the realty to return my security deposit. The realty now is saying that they are going to keep the money and if they don't find other tenants quickly, they are going to use my security deposit to cover their "damages". Is what they are doing legal? Here's what my lease states about the security deposit: "These funds (Security Deposit) shall be held in Escrow while the Tenant goes through the condo application/approval process and shall only be released to the Landlord upon Condo Board Approval". Thanks so much!

Yes...there is no "calling things off" because something unfortunate happened. Once you sign a contract its your responsibility from that point forward.
