More details to this question:
An artist agreed to draw a logo for me for $300. I would pay him half down and upon completion I would pay the remainder. He did the drawing and showed me what he came up with. I did not like the drawing so out of frustration i did not tell him if I liked it or not. So basically since the day he sent me the phot for review we have no spoken. It has been 5months since then. I asked him to do a new portrait for me of something else. He told me he can not start it nor work with me again at all for that matter. I told him I would pay the valence and we can finish the original photo but he told me no he doesn't want to work with me at all. Our agreement was he draw me a picture and upon completion I pay him the rest. Is he breaching contract by refusing to finish even tho it is 5 months later? We never spoke on time limits

It seems to me that you abandoned the project. Why didn't you just tell him you wanted him to adjust the initial drafts? That would have been a normal part of the process. I think he's done his part at this point for the half you paid him.
