Sue a contractor for delays

More details to this question:
I hireda contractor to build a porch. He said he would complete it in 45 days and it has been 90 days and not even close to being completed due to financial issues. However, i payed him all the money already. I gave him a deadline. If he doesnt meet the new deadline..can i sue him and get my money back since the technical breached to contract .

You can set a new deadline in writing by which the contractor must complete the work, and if he doesn't, then you can hire another contractor to finish the work and charge him for it.  Then you can sue him for the balance.  If it's less than $10,000, you can sue in small claims court. Next time, reserve some money until the work in completed to your satisfaction and get payment releases along the way.
