I’m being sued by employer for breach of contract but they never served Me and their suing a LLC which they have no contract for instead they have an employment contract with Me. They breached the contract but in order to protect themselves I’m assuming they filed it first to protect them first.. In the lawsuit they point out a couple of things that come from the employment contract but in the same page they state I’m not an employee and that’s why their suing My LLC which is totally separate and never used with this employer. Only contract they have is an employment contract which it states in bold I’m an employee only.
Hi Christopher - if you have an employment contract it seems strange that the company is suing an LLC. You may have some claims against them for breach of contract, misclassification, wrongful termination, among others. I'd be happy to discuss this with you if you want to set up a time to discuss.
