QUESTION

Vendor asks for additional payment

Asked on Apr 05th, 2023 on Contracts - California
More details to this question:
Hello, My business is in San Francisco, CA. I have been renting equipments from a vendor and I have been paying the bill that they sent me. When I rented the equipment, we didn’t sign any contract and there were no written price on paper. We paid the stated amount every month whatever they billed me. However, I received an email from the vendor yesterday. They told me that the billed amount was incorrect and they needed to charge me for the difference for the past 11 months. Is it legal for them to bill me for the incorrect amount and asked for a difference from 11 months ago? Thank you!

You can definitely fight this given the history established throughout your arrangement with them. However, it doesn't sound like there's anything in place to prevent future price increases, so they can certainly increase the price going forward. I urge you to hire an attorney to handle this and help you get contracts in place with all of your vendors and customers.
