We had a HVAC system installed in 2020 and added a 5 year guarantee on installation/repair/yearly maintenance from Sears. We have been unable to get someone out here to fix or even maintenance our AC. They cancel every appointment for the last 2 years! My drain tube is connected to my upstairs toilet drain. So if you flush the toilet upstairs the waste is pushed out to the septic as well as into this tube. I was going to show you some pictures however I was unable to attach them. I was just wondering if we are safe and any advice you may have

First, a lawyer could send them a letter ($500) to advise them to fix it or get sued for breach of contract.
Second, you may have a statute of limitations (if they promised to come and didn't, we can get around that).
