QUESTION

What are the laws on trading items (cellphone) and the other party is disputing.

Asked on Jul 09th, 2014 on Contracts - New Mexico
More details to this question:
I traded a cell phone with a person online and my phone was in perfect working condition and now the person is stating that the phone isn't working and they want their original phone back. I informed them I didn't want the phone back if its not working and now they are threatening me with calling the police and also blacklisting my phone. I would like to know what rights I have and what can be done about this without going to court or getting the police involved.

I very much doubt that the police will get involved in this private civil dispute.  However, you have no control over whether the matter goes to court.  Unless the two of you can work out a resolution, the other party may decide to sue you.  That is his/her decision.  If what you say is believed by the Court (i.e. that your phone was in perfect working order when received by the other party), you should win the suit.
