More details to this question:
If a contract is signed stating that a broken item will be replaced or paid for and no legal action is to be taken against them can they still get arrested for the item or get a warrant for their arrest?

Yes.  The contract may be binding upon the parties, meaning that the owner will not sue the breaker as long as the breaker replaces or pays for the broken item, but that has nothing to do with any criminal action taken by the state.
